The Dominican Divorce Process: To complete a divorce in the Dominican Republic, one spouse does need to be present to attend the court while the other spouse can be represented by a lawyer. The spouse visiting the Dominican Republic needs to be in the country for one day at minimum, and you may stay longer to enjoy our country and have a great vacation.

Grounds For Divorce:  Incompatibility of the parties is one of the main grounds for divorce under the laws of the Dominican Republic. No fault need be alleged by either party to participate in the Divorce process in the Dominican Republic.

Dominican Divorce Requirements: You don’t need to be a resident in the Dominican Republic in any capacity. The following is a list of requirements which must be true to obtain your Dominican Divorce from your Dominican Divorce Lawyer.

• Both spouses must give their consent
• At least one spouse must travel to the Dominican Republic to be present at the court
• If one spouse does not attend, they must be represented by a power-of-attorney authorizing a representative to appear in court for him/her and to consent to the divorce
• The parties must agree and consent to the jurisdiction of the Dominican Court
